Rear end collisions are the most common type of automobile collision today usually due to the inattentiveness of the offending driver, increased use of cell phones, and other distractions of everyday driving or various options on newer vehicles. Evidence of the offending driver's fault is clearer in a rear-end collision than in any other type of vehicle accident. In most cases, the car that was hit was stopped at a stop light, at a stop sign, or in traffic. In general, the law presumes the rear-ending motorist is at fault because they failed to maintain a safe distance, was following too closely or failed to maintain a reasonable lookout for other vehicles.
